Terms and Conditions

The agreement between you and Sible AI for using our characters, app, and services. Please read carefully — Section 14 includes a binding arbitration clause and class-action waiver.

These Terms and Conditions (“Terms”) form a binding agreement between you and Sible AI (“Sible,” “we,” “us,” or “our”), a Delaware entity, and govern your access to and use of the Sible mobile application, websites, and related services (collectively, the “Service”).

By creating an account, downloading the app, or otherwise using the Service, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.

These Terms include a binding arbitration agreement and class-action waiver (Section 14). Please read them carefully.

01Eligibility

You must be at least 13 years old to use the Service. Some jurisdictions impose a higher minimum age — for example, parts of the European Economic Area require users to be 16. You must meet the minimum age in your jurisdiction. If you are under 18, you represent that you have your parent's or legal guardian's permission to use the Service and that they have read and accepted these Terms on your behalf.

You may not use the Service if you are barred from doing so under applicable law, including U.S. export controls and sanctions.

02Your account

To use most features you must create an account. You agree to provide accurate information, keep your credentials secure, and notify us promptly at team@sible.ai if you suspect unauthorized access. You are responsible for all activity that occurs under your account. You may not share your account or transfer it to another person.

We may suspend or terminate your account if you violate these Terms or applicable law (see Section 13).

03License to use the Service

Subject to your compliance with these Terms, we grant you a limited, personal, non-exclusive, non-transferable, non-sublicensable, revocable license to install and use the Service for your own personal, non-commercial use on devices you own or control. All rights not expressly granted are reserved.

This license is also subject to the usage rules of the Apple App Store and Google Play, as applicable.

04Acceptable use

You agree not to:

  • use the Service for any unlawful purpose, or in violation of any applicable law or regulation;
  • use the Service to generate, request, or share content that is illegal, sexually exploitative of minors, threatens or incites violence, harasses or doxxes another person, infringes intellectual property, or otherwise violates our content guidelines;
  • attempt to extract personal information about other users;
  • reverse engineer, decompile, scrape, or attempt to derive the source code of the Service except where such restriction is prohibited by law;
  • interfere with or disrupt the Service, our infrastructure, or other users' enjoyment of it (including via automated tools, denial-of-service, or rate-limit evasion);
  • use the Service to build a competing product or to train another machine-learning model;
  • impersonate another person or entity, or misrepresent your affiliation with one;
  • circumvent any access, security, or usage limits we apply.

We may investigate and respond to suspected violations, including by removing content and suspending accounts.

05Your content

The Service lets you send text and voice messages, configure characters, and otherwise submit content (“User Content”). You retain ownership of your User Content.

By submitting User Content, you grant Sible a worldwide, royalty-free, sublicensable license to host, store, transmit, process, analyze, reproduce, display, and create derivative works from your User Content solely as necessary to operate, secure, and improve the Service, in accordance with our Privacy Policy. This license is automatically revoked when you delete the relevant content or your account, except (a) for backup copies during normal deletion cycles, (b) for aggregated and de-identified data that no longer identifies you, and (c) where retention is required by law.

You represent that you have all rights necessary to submit your User Content and that doing so does not violate any law or third-party right.

06AI characters and generated content

The Service uses artificial-intelligence models — some hosted by Sible on its own infrastructure and some operated by third-party AI providers — to generate replies, voices, and behavior for fictional characters.

You acknowledge that:

  • AI characters are not real people. They are fictional and any persona, memory, or relationship is generated by software.
  • AI output may be inaccurate, offensive, or inappropriate. Generated content may contain errors, fabrications, or content you disagree with. Do not rely on AI output for advice — including medical, mental-health, legal, financial, or safety advice.
  • The Service is not a substitute for professional help. If you are in crisis, contact your local emergency services or a qualified professional. Sible does not provide therapy or counseling.
  • Generated content is provided “as is.” Sible makes no representation that AI output is suitable for any particular purpose.

You may not represent AI-generated output as having been authored by a real person without making the AI origin clear, and you may not use AI output in a way that violates Section 04.

07Subscriptions and in-app purchases

Some features of the Service require a paid subscription or one-time purchase. All payments are processed through the Apple App Store or Google Play. Pricing, billing cycles, renewals, and refunds are governed by those platforms' terms in addition to ours.

  • Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current billing period through your Apple or Google account settings. Sible cannot cancel platform subscriptions on your behalf.
  • Refunds are administered by Apple or Google according to their policies. Sible does not generally issue refunds for amounts already collected by the platforms.
  • Prices may change. If we change prices for an existing subscription, we will notify you before the change takes effect and you may cancel.
  • Entitlements (premium features, characters, etc.) are tied to the account that made the purchase; they are not transferable.

08Intellectual property

The Service — including software, design, models we own, characters we publish, names, logos, sounds, artwork, and other content provided by us — is owned by Sible or its licensors and is protected by intellectual-property law. Except for the rights expressly granted in Section 03, these Terms do not transfer any rights to you.

If you believe content on the Service infringes your copyright, send a notice that complies with the U.S. Digital Millennium Copyright Act (“DMCA”) to team@sible.ai.

09Feedback

If you send us feedback, suggestions, or ideas about the Service, you grant Sible an unrestricted, royalty-free right to use them for any purpose without obligation to you.

10Disclaimers

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE FULLEST EXTENT PERMITTED BY LAW, SIBLE DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ANY WARRANTIES ARISING FROM COURSE OF DEALING OR USAGE OF TRADE.

WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF HARMFUL COMPONENTS, OR THAT AI-GENERATED OUTPUT WILL BE ACCURATE, COMPLETE, OR APPROPRIATE FOR ANY PURPOSE. YOU USE THE SERVICE AT YOUR OWN RISK.

Some jurisdictions do not allow disclaimers of certain warranties, so some of the above may not apply to you.

11Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT WILL SIBLE OR ITS AFFILIATES, OFFICERS, EMPLOYEES, OR AGENTS BE LIABLE FOR (A) ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, GOODWILL, OR OTHER INTANGIBLES, OR (B) ANY AGGREGATE LIABILITY EXCEEDING THE GREATER OF (i) THE AMOUNTS YOU PAID TO SIBLE FOR THE SERVICE IN THE 12 MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM OR (ii) ONE HUNDRED U.S. DOLLARS ($100), WHETHER IN CONTRACT, TORT, OR OTHERWISE, AND EVEN IF SIBLE HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

Some jurisdictions do not allow these limitations, so some of the above may not apply to you. Nothing in these Terms limits liability that cannot lawfully be limited.

12Indemnification

You agree to defend, indemnify, and hold harmless Sible and its affiliates from and against any claims, damages, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or relating to (a) your User Content, (b) your use of the Service, (c) your violation of these Terms, or (d) your violation of any law or third-party right.

13Suspension and termination

You may stop using the Service at any time and delete your account from inside the app or by emailing team@sible.ai.

We may suspend or terminate your access, with or without notice, if (a) you violate these Terms or applicable law, (b) doing so is necessary to protect Sible, our users, or third parties, or (c) we discontinue the Service or a feature. On termination, your license under Section 03 ends and we will delete your data according to our Privacy Policy. Sections 05 (license to retained content), 08–12, 14, and 15 survive termination.

14Governing law, arbitration, and class-action waiver

14.1 Governing law

These Terms are governed by the laws of the State of Delaware, U.S.A., without regard to its conflict-of-laws rules. The United Nations Convention on Contracts for the International Sale of Goods does not apply.

14.2 Informal dispute resolution

Before filing a claim, you agree to try to resolve the dispute informally by emailing team@sible.ai with a written description of the claim. We will try to resolve the dispute within 60 days of receipt.

14.3 Binding arbitration

If we cannot resolve the dispute informally, you and Sible agree to resolve any dispute, claim, or controversy arising out of or relating to these Terms or the Service by binding individual arbitration administered by JAMS under its applicable rules. The arbitration will take place in Delaware, or by video conference where the rules permit, and will be conducted in English. Judgment on the award may be entered in any court of competent jurisdiction.

Exceptions. Either party may (a) bring an individual claim in small-claims court if it qualifies and (b) seek injunctive or equitable relief in court for intellectual-property infringement or unauthorized access to the Service.

14.4 Class-action waiver

You and Sible agree to bring claims only in your or its individual capacity and not as a plaintiff or class member in any purported class, consolidated, or representative proceeding. If a court finds this class-action waiver unenforceable, the rest of Section 14 is severed and any remaining class or representative claims must be litigated in court.

14.5 30-day opt-out

You may opt out of Section 14 (arbitration and class-action waiver) by sending written notice to team@sible.ai within 30 days of first accepting these Terms. The notice must include your name, account email, and a clear statement that you wish to opt out.

15Changes to these Terms

We may update these Terms from time to time. When we make material changes, we will update the “Last updated” date and notify you (for example, in-app or by email). Your continued use of the Service after a change takes effect constitutes acceptance of the updated Terms. If you do not agree, stop using the Service and, if you wish, delete your account.

16Miscellaneous

  • Entire agreement. These Terms and the Privacy Policy are the entire agreement between you and Sible regarding the Service and supersede any prior agreements.
  • Severability. If any provision of these Terms is unenforceable, the remaining provisions will remain in full force.
  • No waiver. Our failure to enforce a provision is not a waiver of our right to do so later.
  • Assignment. You may not assign these Terms without our prior written consent. We may assign them in connection with a merger, acquisition, or sale of assets.
  • Apple-specific terms. If you use the iOS app, you acknowledge that these Terms are between you and Sible only — not Apple — and that Apple is not responsible for the Service or any claims relating to it. Apple is a third-party beneficiary of these Terms with the right to enforce them against you.
  • Google-specific terms. If you use the Android app, similar provisions apply with respect to Google.
  • Force majeure. We are not liable for delays or failures caused by events beyond our reasonable control.
